Oleica, a registered trademark of the start-up Technological Applications for the Improvement of Quality and Safety in Foods (hereinafter TAFIQs in FOODs), are the owners of this website https://www.oleica.es/es/formacion/ (hereinafter, the Website).

Its registered office and fiscal domicile are located at Carretera de Marbella 22, Floor -1. CP. 29108. Guaro (Málaga – Spain). The entity TAFIQs in FOODs is duly constituted as indicated in the Legal Notice.

2. PREAMBLE

This document (together with all documents mentioned therein) establishes the conditions governing the use of this Website and the purchase and delivery of training courses.

Please read these Terms and Conditions, the Legal Notice, our Cookie Policy, and our Privacy Policy carefully before using this Website. By using this Website and registering as a user or student through it, you consent to be bound by these conditions.

The “User” shall be understood as the natural or legal person who, after accepting these Conditions, creates an account or registers as a student in the online courses.

Acceptance of these General Terms and Conditions is mandatory and essential for the purchase of the Course. Therefore, such acceptance shall occur at the time of the User’s registration for the Course.

These Conditions shall govern the relationship between the Parties TAFIQs in FOODs and the User. TAFIQs in FOODs reserves the right to modify these Terms and Conditions established for the subscription to the Course through the Website when it deems it appropriate or to adapt such texts to legislative and technological changes, being valid and effective upon publication on the Website of the new versions. The temporary validity of these Terms and Conditions coincides, therefore, with the time of their exposure, until they are modified in whole or in part, at which time the modified conditions shall become effective, and such modifications shall not affect subscriptions made prior to their entry into force.

3. OBJECT

TAFIQs in FOODs through this Website provides the online training service through Courses, separated by theme or itinerary. (In case of requiring face-to-face training, please consult conditions through [email protected]).

The Course offers you a limited right of access to the content of this Website (30 days from acceptance), provided that you comply with these Terms and Conditions. The educational material of the Course available on this Website is for private use only and can only be viewed through the Web (download is not possible). The services offered are only accessible to students subscribed to the Course. By subscribing as a student to the Course, the User agrees to comply with these Terms and Conditions.

Once the classes of the course level are completed, the User will receive an exam. Once this is passed, you will receive a Certificate of Achievement certifying that you have successfully completed the chosen Course. (The information for each particular course will be detailed specifically in each of the itineraries).

The Courses are of a non-regulated teaching nature and do not lead to the obtaining of an official title. No academic qualifications are required to receive the Courses. The teachers of TAFIQs in FOODs are professionally qualified for their teaching work and trained in the methodology developed and applied.

4. ACCESS AND USE OF THE WEBSITE

The User of the Course must be of legal age and will be responsible for providing truthful and lawful information, guaranteeing the authenticity of all data entered when completing the pre-established forms for registration in the Course.

If, as a result of the registration, the User is provided with a username and password, or other similar means of identification and authentication, he/she agrees to use them diligently and to guarantee the confidentiality of the same. Consequently, Users are responsible for the proper custody and confidentiality of any identifiers and/or passwords provided to them by TAFIQs in FOODs, and undertake not to transfer their use to third parties, whether temporarily or permanently, or to allow their use by third parties.

The User shall be solely responsible for the use of the Course offered on the Website by any third party who uses an identifier and password supplied to the User, as a result of a negligent act, voluntary provision, or loss thereof by the User without notifying TAFIQs in FOODs.

In virtue of the foregoing, it is the User’s obligation to immediately notify TAFIQs in FOODs of any fact that allows the improper use of the identifiers and/or passwords, such as theft, loss, or unauthorized access to them, in order to proceed to their immediate cancellation. Until such facts are communicated, TAFIQs in FOODs shall be exempt from any liability that may arise from the improper use of the identifiers or passwords by unauthorized third parties, and any request, use, provision, and/or contracting of products or services shall be deemed to have been made by the User himself, who shall therefore be solely responsible for such acts.

The access, navigation, and use of the Website and, the use or contracting of the Course are made under the sole and exclusive responsibility of the User, who undertakes to observe diligently and faithfully any additional instructions, given by TAFIQs in FOODs or by authorized personnel of TAFIQs in FOODs, regarding the use of the Website and its contents. Likewise, the User undertakes to use the contents of the Course diligently, correctly, and lawfully, in accordance with current legislation.

All contents of the Website, unless otherwise indicated, are the exclusive property of TAFIQs in FOODs and, with an enunciative character, not limiting, the graphic design, source code, logos, texts, graphics, illustrations, and other elements appearing on the Website.

TAFIQs in FOODs does not grant any kind of license or authorization of personal use to the User regarding its rights of ownership of the Online Course or any other right related to its Website and the services offered therein.

Therefore, the User acknowledges that the reproduction, distribution, commercialization, transformation, transfer, and, in general, any other form of exploitation, by any procedure, of all or part of the contents of this Website constitutes an infringement of the intellectual property rights of TAFIQs in FOODs.

5. PRICE AND PAYMENT

The training courses offered on the Website, along with their characteristics and prices, will be displayed on the screen. The prices indicated on the screen are in Euros and include, if applicable, any tax that may apply and will be, at all times, current.

On the Website https://www.oleica.es/es/formacion/, the different courses to be taught will be presented. Each of them will have a section enabled for this purpose containing all the information related to the course. Additionally, there will be a form that Users wishing to purchase the online course must complete to subsequently make the payment through the payment platform (in case there is no payment platform, it will be specified that payment will be made by bank transfer, the bank account number, or where this data can be consulted).

The User can securely pay for the Course through bank transfer after registering on the platform.

In the payment platform associated with the Website, the required data must be entered into the fields enabled for this purpose. To complete the purchase of the Course, you must follow the online purchase procedure and send by email to the address enabled for this purpose, [email protected], the payment receipt. After completing the purchase, you will receive an email acknowledging receipt of your order (the “Order Confirmation”) along with the invoice, the terms and conditions of the purchase, and the withdrawal document. Registration for the Course will be effective once the previous operation has been validated.

TAFIQs in FOODs reserves the right to change prices or propose special promotions, among other actions, at any time, after announcing it on the Website for a reasonable time and having informed the members by email. Possible changes will not affect registrations that have already been made.

6. REGISTRATION IN THE COURSE

Registration for the Course is guaranteed as long as there are available slots, and payment has been successfully completed by the User.

The Course begins once the User registers and receives the access keys. Registration for the Course can be done at any time of the year.

Payment for the Course entitles the User to access a single course, being able to choose from all those offered. Within one (1) natural day from the start of the Course, the User may request a change of course.

The lessons of the Course are available during the contracted access period (30 days). Therefore, if they are not used before the subscription period ends, the unused lessons will be lost and will not be refunded.

7. RIGHT OF WITHDRAWAL

The User, if contracting as a consumer and user, shall have the right to withdraw from and cancel the registration in the Course through the Website, without the need to justify their decision and without any penalty, within a period of one (1) natural day from the date of online registration.

TAFIQs in FOODs advises the User to communicate their intention to withdraw from the contract using the withdrawal form model that can be downloaded from the Website and that can be sent to [email protected], although its use is not mandatory. To comply with the withdrawal period, it is sufficient that the communication regarding the exercise of this right is sent before the corresponding deadline expires.

In the event of the aforementioned withdrawal, TAFIQs in FOODs will proceed to refund 75% of all payments received from you without undue delay and, in any case, no later than thirty (30) natural days from the date on which we are informed of your decision to withdraw from this contract. We will make this refund using the same means of payment used by you for the initial transaction. You will not incur any expenses as a result of the refund, except for 25% for bank management and processing fees.

8. PRIVACY POLICY

The Privacy Policy is an integral part of these Terms and Conditions. You must read and be aware of the Privacy Policy, especially when providing or facilitating personal data through the Website.

TAFIQs in FOODs protects personal data in accordance with the provisions of the Organic Law on Data Protection. Information on the protection of personal data is included in the Privacy Policy. TAFIQs in FOODs has taken the necessary measures to prevent alteration, loss, treatment, or unauthorized access to personal data.

The information or personal data you provide us about you will be processed in accordance with the provisions of the Privacy Policy. By using this Website, you consent to the processing of such information and data and declare that all the information or data you provide to us is true and corresponds to reality.

9. COMMUNICATIONS

For any communication between TAFIQs in FOODs and the User, the User must address TAFIQs in FOODs at the postal and/or email address indicated in the Legal Notice. In any case, communications from TAFIQs in FOODs to the User will be made to the contact details provided or provided, preferably electronically. To this end, the User expressly accepts the use of email as a valid procedure for the exchange of information and the sending of communications between and/or with TAFIQs in FOODs.

10. GENERALITIES

The headings of the various clauses are for informational purposes only and shall not affect, qualify, or modify the interpretation of the Terms and Conditions. In the event of any discrepancy or contradiction between the provisions of these Terms and Conditions and the specific conditions that may be established regarding the Course offered on the Website, the provisions of the specific conditions shall prevail.

In the event that any provision or provisions of these Terms and Conditions is considered null or unenforceable, in whole or in part, by any competent Court or administrative body, such nullity or unenforceability shall not affect the remaining provisions of the Terms and Conditions or the specific conditions that may have been established, if any. The failure or non-performance by TAFIQs in FOODs of any right or provision contained in these Terms and Conditions shall not constitute a waiver thereof, unless acknowledged and agreed in writing by TAFIQs in FOODs.

11. COMMENTS, SUGGESTIONS, COMPLAINTS, AND CLAIMS

12. APPLICABLE LAW AND COMPETENT COURTS

These Terms and Conditions and the relationships established between TAFIQs in FOODs and the User, particularly the knowledge and resolution of any disputes, discrepancies, or differences that may arise, shall be governed and resolved in accordance with Spanish legislation regarding applicable law and competent jurisdiction and shall be resolved in the courts of Malaga (Spain).
